01 · Acceptance of Terms

By accessing or using the Tradephex platform (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

These Terms form a binding agreement between you and Tradephex LLC, a Pennsylvania limited liability company.

02 · Nature of the Service

Tradephex operates a futures evaluation program using simulated trading data. We are not a registered broker-dealer, futures commission merchant, or investment advisor. No real money is at risk during evaluations.

Funded accounts trade simulated capital. Payouts are funded from Tradephex's own profit pool, not from a customer's real trading proceeds.

03 · Eligibility

You must be at least eighteen (18) years old to use the Platform. By creating an account, you represent that you meet this age requirement and that all information you provide is accurate and complete.

04 · Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately at support@tradephex.com of any unauthorized access.

You may not share your account, sublicense access, or use the Platform on behalf of another individual or entity without written permission.

05 · Evaluation Rules

Evaluations are governed by the rules published on the Evaluations page at the time of purchase. Rules include but are not limited to:

• Profit target (typically six percent)
• Maximum drawdown (typically five percent)
• Daily loss limit (typically two percent)
• Minimum trading days (typically five)
• Consistency rule (no single day exceeds forty percent of total profit)

Breach of any rule ends the evaluation. Eval fees are non-refundable once the evaluation begins.

06 · Payouts

Funded traders may request payouts on demand once they have profit available. Payouts are subject to a ninety percent (90%) profit split.

Tradephex reserves the right to delay or deny payouts in cases of suspected rule violation, identity verification issues, or pending tax documentation.

Standard payout processing time is one to five business days following approval.

07 · Tax Obligations

Funded traders are solely responsible for reporting income and paying any applicable taxes. Tradephex will issue Form 1099-NEC to US-resident traders who receive total payouts of $600 or more in a calendar year.

Foreign traders must complete Form W-8BEN before any payout will be processed.

08 · Refund Policy

Eval fees are non-refundable once the evaluation has begun. Refer to the Refund Policy for full details on cancellation and refund eligibility.

09 · Prohibited Conduct

You may not, while using the Platform:

• Reverse-engineer, decompile, or scrape the Platform or its underlying systems
• Use bots, automated scripts, or unauthorized API access
• Engage in coordinated trading across multiple accounts
• Misrepresent your identity, location, or eligibility
• Use the Platform for any unlawful purpose

Violation may result in account termination, evaluation forfeiture, and forfeiture of any pending or earned profit.

10 · Intellectual Property

All Platform code, branding, charting tools, AI scoring models, and content are the exclusive property of Tradephex LLC and its licensors. You receive a limited, non-exclusive, non-transferable license to use the Platform during your active subscription or evaluation.

11 · Disclaimers

The Platform is provided "as is" and "as available." We make no warranties, express or implied, regarding accuracy, uptime, fitness for any purpose, or suitability for any particular trading style.

12 · Limitation of Liability

To the maximum extent permitted by law, Tradephex LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, data, or business opportunities, arising from or related to your use of the Platform.

Our total liability for any claim arising under these Terms shall not exceed the amount you paid Tradephex in the twelve months preceding the claim.

13 · Indemnification

You agree to indemnify and hold harmless Tradephex LLC, its officers, employees, and affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your use of the Platform.

14 · Modifications

We may revise these Terms from time to time. Material changes will be communicated via email or prominent notice on the Platform. Continued use after changes are posted constitutes acceptance.

15 · Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of Cumberland County, Pennsylvania.
